If you rent out a house and realize in not in liveable condition can you get your deposit back?
ByI rented out a house and realized within a few weeks that there was rats and roaches. There was not a whole lot that could be done because I was 8 1/2 months pregnant. What the landlord did try didn’t work. I called the landlord and told her that the house is not liveable and I will not bring a newborn baby home to those conditions. i only gave her about a two week notice and told her at the end of that month I would be moving out. I lived there a total of two months. She will not give me back ANYt of the deposit because she said that I did not give proper 30 day notice. Can she do that since the house was in such bad condition? My dog was always carrying around the rats, it was horrible? i live in AZ and I was wondering if she can enforce the 30 day notice with the house in that condition. Thanks!

Did you not inspect the residence before you rented it? I can’t see how you could have, because rats AND roaches would have been very hard to overlook, it seems like. And you stayed there for 2 months?
I don’t know if AZ is pro tenant or pro landlord, but it seems like you may be pretty well stuck this time, unless there is a provision in your lease for extenuating circumstances.

See if your state has a Fair Housing agency. Also call your local health dept for an inspection. This should give you the leverage you need for cancelling the agreement.
